Our Perspective on ADR
At Perspective, our dispute resolution process is influenced by the critical art of scientific learning and rethinking, as examined by Adam Grant in his book “Think Again.” We recognize that:

Our Approach to Mediations
Success is not solely determined on the day of the mediation. Proper preparation is key. At Perspective ADR, we begin preparing for a successful mediation the moment you schedule it. You can expect to:
Submit a shared mediation brief detailing your positions, coupled with a confidential supplemental submission that offers a more candid view of your case for the mediator’s eyes only.
Engage in separate pre-mediation conferences. These conferences are designed to get to better know you, your counsel, as well as your positions, motivations, emotions, and goals.
Participate in a focused mediation geared towards reaching a resolution that leaves both parties feeling validated.

Our Approach to Early Neutral Evaluations
We approach an ENE the same as a mediation, with proper preparation and focus. You can expect to:
Submit a written statement, supported by evidence and testimony in support of your position.
File a short rebuttal responding to the other side’s submission.
Participate in a hearing at which we will ask clarifying questions, identify areas of agreement and disagreement, and otherwise drill down on the facts and law of the case.
Receive a written evaluation of the relative strengths and weaknesses of each side’s case, the reasoning supporting this assessment, and, where possible, the likelihood of liability and an estimated damages range. (Receipt of the evaluation can be postponed in the event the parties wish to engage in settlement discussions or make additional disclosures.)
